Acceptance of Terms
By accessing or using the TSKR platform or any associated services operated by TSKR Labs Limited, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms applicable to specific features.
If you are using the service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" refers to that entity.
Description of Service
TSKR Labs Limited ("TSKR", "we", "us", "our") provides an AI-powered productivity and task management platform that helps individuals and teams capture, organise, prioritise, and complete work.
The service is provided as software-as-a-service (SaaS) and may include web, mobile, and API access. We reserve the right to modify, enhance, or discontinue any feature at any time with reasonable notice where practicable.
Eligibility
To use the service, you must be at least 18 years of age. By using the service, you represent and warrant that you meet this requirement.
Use of the service is not permitted in any jurisdiction where doing so would be prohibited by applicable law.
User Accounts
You must register for an account to access the service. When creating your account, you agree to:
- →Provide accurate, current, and complete information.
- →Keep your account information up to date.
- →Maintain the security and confidentiality of your login credentials.
- →Not share your account with or transfer it to any other person.
- →Notify us immediately at eoin@tskr.app if you suspect any unauthorised access.
You are solely responsible for all activity that occurs under your account. We are not liable for any loss resulting from unauthorised use of your account where you have failed to maintain the security of your credentials.
Acceptable Use
You agree to use the service only for lawful purposes and in accordance with these Terms. You must not:
- →Violate any applicable Irish, EU, or international law or regulation.
- →Infringe the intellectual property rights of TSKR or any third party.
- →Transmit unsolicited commercial communications (spam) or malicious code.
- →Harass, abuse, threaten, or harm other users or third parties.
- →Attempt to gain unauthorised access to any part of the service or its infrastructure.
- →Use automated means (bots, scrapers, crawlers) to access the service without our prior written consent.
- →Reverse engineer, decompile, or disassemble the service.
- →Use the service to store or process any data in violation of applicable data protection law.
- →Interfere with or disrupt the integrity, performance, or availability of the service.
We reserve the right to investigate and take appropriate action, including suspension or termination of your account, for any suspected violation of this section.
Content & Intellectual Property
Your content. You retain full ownership of any data, files, projects, and other content you create, upload, or store using the service ("User Content"). You are solely responsible for ensuring your User Content does not violate any applicable law or third-party rights.
By uploading or inputting User Content, you grant TSKR Labs Limited a limited, non-exclusive, worldwide, royalty-free licence to access, store, reproduce, and process that content solely to the extent necessary to provide and improve the service. This licence terminates when you delete your content or close your account, subject to any legal retention obligations.
Our intellectual property. All rights in the TSKR platform, including software, design, trademarks, branding, and documentation, are owned by or licensed to TSKR Labs Limited. Nothing in these Terms transfers any intellectual property rights to you. You receive a limited, non-transferable, non-sublicensable licence to use the service for its intended purpose during your subscription.
Payment & Billing
Certain features of the service require a paid subscription. By subscribing to a paid plan, you agree to pay all applicable fees at the rates listed at the time of purchase.
- →All prices are displayed in Euro (EUR) unless otherwise stated and are inclusive of applicable VAT where required under Irish and EU law.
- →Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected).
- →Payment is processed by a third-party payment provider; we do not store your full payment card details.
- →You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
- →Fees are non-refundable except as required by the Consumer Rights Act 2022 (Ireland) or other applicable Irish consumer protection law, or as expressly stated in our refund policy.
We reserve the right to change pricing with a minimum of 30 days' notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
If you are a consumer (as defined under Irish consumer protection law), your statutory rights are not affected by these Terms.
Data Protection & Privacy
TSKR Labs Limited is committed to protecting your personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Data Protection Acts 1988 to 2018 (Ireland).
TSKR Labs Limited acts as a data controller in respect of personal data you provide when registering and using the service. Where you provide personal data relating to other individuals through your use of the service, you are responsible for ensuring you have a lawful basis for doing so.
Details of how we collect, use, store, and protect personal data, including your rights as a data subject, are set out in our Privacy Policy, which forms part of these Terms. By using the service, you acknowledge that you have read and understood our Privacy Policy.
Any complaints relating to our processing of personal data may be directed to the Data Protection Commission (Ireland) at dataprotection.ie.
Disclaimers
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by Irish and EU law, TSKR Labs Limited makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- →The service will be uninterrupted, error-free, or free from viruses or other harmful components.
- →Any errors or defects will be corrected.
- →Results obtained through use of the service will be accurate or reliable.
Nothing in these Terms affects any statutory rights you may have under Irish consumer protection law that cannot be excluded or limited.
Limitation of Liability
To the maximum extent permitted by applicable Irish and EU law, TSKR Labs Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption, arising from your use of or inability to use the service.
Our total aggregate liability to you in connection with these Terms or the service shall not exceed the greater of:
- →The total fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim; or
- →€100.
These limitations do not apply to liability arising from death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Irish law.
Termination
By you. You may terminate your account at any time by using the account settings in the platform or by contacting us at eoin@tskr.app. Termination does not entitle you to a refund of prepaid fees except where required by law.
By us. We may suspend or terminate your access to the service immediately, with or without notice, if we reasonably believe you have materially breached these Terms, engaged in conduct harmful to other users or to TSKR, or where required to do so by law.
Upon termination, your right to access the service ceases immediately. We will handle your data following termination in accordance with our Privacy Policy and applicable data protection law. You may request an export of your data before terminating your account.
Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from or in connection with these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Ireland.
If you are a consumer resident in another EU member state, you may also be entitled to bring proceedings in the courts of your country of residence under applicable EU consumer protection rules.
You may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr for resolving disputes.
Changes to Terms
We may update these Terms from time to time. Where changes are material, we will provide at least 30 days' notice by email or by displaying a prominent notice within the service before the changes take effect.
If you do not agree to the revised Terms, you should discontinue use of the service before the effective date of the changes. Continued use of the service after that date constitutes acceptance of the updated Terms.
The "Last updated" date at the top of this page reflects the most recent revision.
